ARTICLE 1 - DESIGNATION OF THE SELLER
The houseofpeau.com website is published by House of Peau SASU, a SASU with capital of 22,296 euros, headquartered at 21 rue de flore 95610 Eragny Sur Oise, registered with the RCS of Cergy Pontoise under number 981294259.
ARTICLE 2 - GENERAL PROVISIONS RELATING TO THESE GENERAL TERMS AND CONDITIONS OF SALE (HEREINAFTER GTSC)
1. Purpose of the General Terms and Conditions of Sale (GTCS)
The GTCS exclusively govern the online sale of House of Peau products on the houseofpeau.com website, which is accessible to all.
2. Scope of the GTCS
The GTCS apply solely to online sales contracts for House of Peau products (hereinafter referred to as the professional seller) concluded with buyers acting as consumers (hereinafter referred to as consumers). Together with the online order, they constitute the contractual documents binding on the parties, to the exclusion of any other document, prospectus, catalog or photograph of the products, which are for information purposes only. They are written in French, as is all contractual information mentioned on the site.
3. Availability and enforceability of the GTC
The GTC are directly accessible to consumers on the seller's website. Confirmation of the order by the consumer implies acceptance of the GCS in force at the time of the order, which the seller shall keep and reproduce in accordance with article 1127-2 of the French Civil Code (former C. civ., art. 1369-4).
4. Modification of the GTC
These GTC were updated on November 13, 2023. The professional seller reserves the right to modify them at any time. In the event of modification, the applicable GCS are those in force at the date of the order, a dated copy of which can be supplied to the consumer on request.
5. Clauses of the GTC
The nullity of a contractual clause does not entail the nullity of the GTC. The temporary or permanent non-application of one or more clauses by the professional seller shall not be construed as a waiver of the other clauses of the GCS, which shall remain in full force and effect.
ARTICLE 3 - PRODUCTS
1. Characteristics
Each product offered for sale in the site catalog is described in terms of its essential characteristics, in accordance with Article L. 111-1 of the French Consumer Code. The images illustrating the products have no contractual value.
2. Use of products
The site offers products intended for skin care. Some products, such as essential oils, can be concentrated and powerful, requiring appropriate use. House of Peau provides consumers with the information they need to use these products properly. The information on essential oils is not medical in nature, and any therapeutic use must be supervised by a health professional. House of Peau cannot be held responsible for any damage resulting from incorrect use of the products or failure to observe the precautions for use.
3. Compliance
The products comply with the standards of safety, health, fair trading and consumer protection in force at the time they are placed on the market, in accordance with French legislation in force at that time.
4. Stock availability
Products are offered and delivered while stocks last. In the event of unavailability of an ordered product, the seller will immediately inform the buyer, and may offer an equivalent product or a refund. If the buyer does not agree, a refund will be made within 10 working days. With the exception of reimbursement of the price of the unavailable product, the seller is not liable for any cancellation indemnities, except in cases of personal imputability.
5. Resale of products
The resale of products on the site requires the prior written agreement of House of Peau. In addition, the reconditioning and resale of products from the site also require the written consent of House of Peau.
ARTICLE 4 - PRICES
1. Pricing
In accordance with article L. 112-1 of the French Consumer Code, sales prices are specified in euros, inclusive of all taxes, for each product listed in the electronic catalog. We also indicate the price before tax. Delivery and transport costs, which are separate, are specified before the order is validated and added on top.
The total amount to be paid by the consumer is displayed on the order confirmation page. The selling price of a product is that in force on the date of the order. Shipping costs, which are not included in the selling price of the products, are invoiced in addition.
In the event of a price-based promotion, the professional seller undertakes to apply the promotional rate to all orders placed during the announced promotional period.
2. Modification
The professional seller reserves the right to modify its prices at any time, while assuring the consumer of the application of the rate in force at the time of the order.
3. Charges
Any additional costs relating to transport, delivery or postage (in addition to any other charges borne by the seller), of which the customer has been informed prior to placing the order, are detailed on the order form.
ARTICLE 5 - OFFER
1. Scope of application
The online sales offers proposed on the site are intended for consumers residing in the marketing areas.
2. Duration
Unless a specific duration is indicated to the contrary, the online sales offers presented on the site remain valid as long as the products are available in the electronic catalog and within the limits of available stocks.
3. Confirmation
The consumer's acceptance of the offer is confirmed by the double-click process, with the validation of the order.
ARTICLE 6 - ORDER
1. Contract Conclusion Process
To place an order, the customer fills in the virtual shopping basket, selecting the products and indicating the quantities required. They then click on the "Order" button and fill in the delivery and payment details.
Before confirming the order by clicking on the "Confirm order" button, customers can check the details of their order and its total price, and return to previous pages to correct any errors or adjust their order.
Confirmation of the order constitutes acceptance of the General Terms and Conditions of Sale (GTCS) and formalizes the conclusion of the contract.
The seller will promptly send an e-mail acknowledging receipt of the order and payment.
2. Modification of the Order
Any modification of the order by the consumer after confirmation is subject to the approval of the professional seller.
The professional seller reserves the right to make modifications to the product ordered linked to technical developments, in accordance with the conditions set out in article R. 212-4 of the French Consumer Code.
3. Order validation
The professional vendor reserves the right to refuse an order for legitimate reasons, in particular if the quantities of products ordered appear abnormally high for consumers. It may also refuse or delay the processing of an order in the event of suspected fraud, such as identity theft or theft of means of payment.
ARTICLE 7 - CONTRACT
1. Conclusion of the Contract
The sales contract takes effect as soon as the consumer sends confirmation of his order.
2. Archiving and Proof
Communications, order forms and invoices are archived in a reliable and durable manner, thus constituting a faithful and durable copy, in compliance with article 1360 of the French Civil Code (formerly C. civ., art. 1348). These documents may be used as proof of the contract.
ARTICLE 8 - PAYMENT
1. Payment
The total amount of the order is due as soon as it is confirmed. Payment is made immediately when the order is placed by credit card.
2. Payment security
The site is equipped with a secure online payment system which enables the consumer to encrypt the transmission of his/her bank details via the secure payment platform's electronic payment server. At no time will the consumer's bank details circulate through the House of Peau computer system.
ARTICLE 9 - DELIVERY
1. Definition
Delivery corresponds to the transfer of physical possession of the goods to the consumer.
2. Shipping time
Under normal conditions, the professional seller will process orders from Monday to Friday, excluding public holidays. House of Peau undertakes to dispatch orders within 24 working hours of validation, subject to stock availability.
3. Delivery times
Once prepared, the order will be entrusted to La Poste Colissimo or Mondial Relay, at the customer's choice, for delivery within 2 to 3 days in Metropolitan France or Belgium.
For orders to DOM TOM or abroad, La Poste or its subsidiaries will also be used, with delivery by their local partner. Delivery times vary according to the region or country of delivery. In general, delivery takes between 5 and 10 working days.
In order to facilitate the delivery of the parcel by the carrier, the customer undertakes to take the necessary measures, such as ensuring that the name is visible on the letterbox and providing a key code or telephone number.
4. Late delivery
In the event of late delivery exceeding 5 working days, the customer must inform House of Peau customer service, who will take the necessary measures.
5. Place of delivery
Products are delivered to the address specified by the customer on the order form. In the event of absence, the carrier may deliver the package to a nearby relay point.
6. Conformity of products
In the event of non-conformity of the product in relation to the order, the consumer must address a complaint to the professional vendor in order to obtain replacement of the product or, where appropriate, resolution of the sale.
7. Transfer of ownership
From the delivery date indicated on the order form, ownership of the product is transferred to the purchaser, unless full payment of the price has not been received at the time of order.
ARTICLE 10 - PRODUCT RETURNS AND RIGHT OF WITHDRAWAL
Consumers have a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, by requesting either an exchange or a refund. Return shipping costs are at the customer's expense, except in the event of an error on our part (defective product or preparation error).
To exercise this right, simply contact our customer service department via the "Contact us" section of our website. An acknowledgement of receipt will be sent by e-mail to confirm that the request has been taken into account.
Return conditions:
- Sealed products: Items with a security seal (e.g. warranty sticker) can only be returned if the seal is intact.
- Opened or unsealed products: For reasons of hygiene and health protection, returns of products that have been opened or unsealed, or whose integrity cannot be verified, will not be accepted, particularly for Algae Jelly Masks.
- Items must be returned in their original condition, complete and undamaged, allowing them to be sold as new.
In the event of retraction, House of Peau will reimburse all payments received in full, via the method of payment used at the time of purchase (credit card or PayPal account). Reimbursement may be deferred until receipt and verification of returned products.
ARTICLE 11 - PROCESSING OF PERSONAL DATA
House of Peau processes consumer information in accordance with its Privacy Policy.
ARTICLE 12 - DISPUTE RESOLUTION
House of Peau cannot be held responsible for damage resulting from improper use of its products.
In the event of a dispute, you should first contact the company's customer service department by e-mail ([email protected]) to try to resolve the matter informally.
ARTICLE 13 - APPLICABLE LAW
This contract and the GTC governing it are governed by French law.
